Overview

The Government of India has introduced the Food Safety and Standards Act, 2006 for the purpose of regulating and stopping the food industry. The Food Safety and Standards Act, 2006 includes laws that direct the sale, manufacturing, storage, distribution and import of food items within the country. Obtaining FSSAI license is mandatory for all food business operators. It is also mandatory for them to show licenses within the premises and license number on the labeling and packaging of food product. Food business operators with FSSAI license are required to file FSSAI annual returns.

The term food safety guarantees that food is healthy and hygienic and free from diseases such as abdominal pain, poisoning, etc. Food Safety and Standards Act, 2006 to ensure the purity of food and packaged foods. It has formulated food safety laws and regulates the food industry related to manufacturing, sales, storage, distribution and imports.

Who should file FSSAI Annual Return?

  • Businesses involved in food production, import, export, sale are required to file for FSSAI annual returns. Those who are involved in the manufacture and distribution of milk should file half-yearly returns.
  • Every FBO with a turnover equal to or greater than Rs. 1.2 million.

Fines and late fees

As per Section 2.1.13 (3) of the FSS (Licensing and Registration) Regulations, 2011, if food business administrators do not file returns within the stipulated time period, they will be fined Rs 100 at that time. Continuing and expanding if the default goes forward.

Additional Regulations

  • A food business must comply with the given compliance:
  • FSSAI rules states factory’s sanitary and hygiene and also keep a record of worker’s hygiene.
  • Keep records of manufacturing, raw materials, usage, and sales on record independently.
  • Guarantee that raw material sources and criteria are of ideal quality.
  • Sale, not to produce, store or disclose any article of food on any premises. This is part of the capacity of any privacy, urinal, boring, channel or waste issue.
  • On a daily basis, clean machines and other equipment.
  • Guaranteed to test synthetic synthetic as well as microbiological contaminants in foods once a year at any rate.

How to File Annual Return?

Business operators can file FSSAI annual returns as per their convenience. The annual return form is available in two forms; The operator can fill it either electronically or physically as the form is also available in physical form.

The details to be included in the FSSAI Annual Return:

  • The name of the food product that is being manufactured, exported, imported or handled.
  • Bottle size, shape or any other package size
  • Quantity in metric tons
  • Value
  • The quantity in kilograms that is being exported or imported
  • Sales per unit packaging or per kg
  • Names of countries where food products are exported
  • Rate of packaging CIF / FOB per unit or per kg
  • Compulsory FSSAI Annual Return

It is mandatory for food business operators to file. There are two types of returns:

  • FSSAI Form D1
  • FSSAI Form D2

FSSAI Form D1

Food business units involved in manufacturing, import, labeling, packing, re-labeling, and re-packing are required to file Form D1 to file for FSSAI Form D1. The farm has been set by the Food Safety Commissioner and is a mandatory item for the FBO despite being involved in production.

The FSSAI Annual Return, Form D1 must be filed on or before 31 May of each financial year. The form is filed with the licensing authority based on the type of food products sold by the FBO in the preceding financial year.

FSSAI Form D2

Form D2 is filed semiannually and not every food business operator is eligible to file Form D2. Instead, FSSAI license holders who are involved in the manufacture and distribution of milk or milk products can file Form D2.

Form D2 is filled from 1 April to 30 September and from 1 October to 31 March of each financial year..
